These Terms of Service govern use of the CDubz DeZigns website and purchases, inquiries, custom-order requests, and other transactions made through or in connection with the website. These Terms should be read together with the Shipping Policy, Returns, Exchanges & Final Sale Policy, Order Cancellation & Changes Policy, Custom Apparel Policy, Boutique Experiences Booking, Cancellation & Travel Policy, Privacy Policy, Customer Service & Communication Policy, Payment & Pricing Policy, Product Information, Sizing & Care Policy, and Intellectual Property & Customer-Submitted Content Policy. If an order-specific quote, invoice, approval, booking confirmation, or written agreement includes terms that differ from these general Terms, the order-specific terms will control for that transaction to the extent of the difference, subject to applicable law.
1. Website Use and Acceptance of Terms
By using the CDubz DeZigns website, submitting an order or inquiry, or purchasing a product or service through the website, customers and visitors are subject to these Terms and the policies referenced above. If a person does not agree with the applicable terms, they should not complete a purchase or use the website in a manner that requires acceptance of those terms.
CDubz DeZigns may update these Terms from time to time as the website, products, services, business practices, or legal requirements change. The version posted on the website at the time of a transaction will generally apply to that transaction unless otherwise stated.
2. Eligibility and Accurate Information
Customers must be legally able to enter into a purchase or service agreement in the jurisdiction where they live. A person placing an order on behalf of a business, organization, event host, or another person represents that they are authorized to do so.
Customers are responsible for providing complete and accurate information, including names, contact details, shipping or event addresses, garment selections, sizes, quantities, personalization, artwork instructions, and other information required to complete an order or booking.
3. Products, Services, and Availability
CDubz DeZigns may add, change, discontinue, limit, or update products, collections, custom-order options, Boutique Experiences, package details, designs, materials, colors, sizes, or other offerings at any time. Availability may depend on current inventory, supplier stock, production capacity, event scheduling, or other business considerations.
Product photographs, mockups, digital previews, and screen colors are intended to represent products as accurately as reasonably possible. Actual garment color, texture, scale, print placement, or appearance may vary slightly because of display settings, manufacturing tolerances, fabric characteristics, production methods, or other normal variations. Additional product-description, sizing, fit, appearance, and care expectations are addressed in the Product Information, Sizing & Care Policy.
4. Orders and Right to Accept or Decline
An order submission or payment does not require CDubz DeZigns to accept or fulfill an order when there is a pricing error, unavailable product or material, suspected fraud, rights or content concern, technical issue, production limitation, or other reasonable basis that prevents the order from being completed as submitted.
If CDubz DeZigns cannot accept or complete an order after payment has been received, the customer will be contacted and an appropriate refund, modification, substitution, or other resolution will be provided for the affected portion of the order, as applicable.
5. Pricing, Taxes, and Website Errors
Prices, package amounts, promotions, shipping charges, and product availability may change without notice unless a price has already been confirmed for a specific order or booking. Applicable taxes, shipping, delivery, travel, customization, or other charges may be added as shown at checkout or stated in the applicable quote, invoice, or booking terms.
CDubz DeZigns may correct typographical errors, pricing mistakes, inaccurate product information, technical errors, or omissions on the website. If a material error affects an order that has already been submitted, CDubz DeZigns may contact the customer to confirm corrected terms or cancel and refund the affected item or order when necessary.
6. Payments
Website payments are processed through Shopify and/or authorized payment providers. Customers agree to provide valid payment information and authorize the applicable charges associated with their order. Website pricing and payment practices are also governed by the Payment & Pricing Policy.
Custom, bulk, specialty, or Boutique Experience transactions may use quotes, invoices, retainers, deposits, installments, or other payment arrangements. The payment amount, due dates, refundability, and other transaction-specific terms stated in the applicable quote, invoice, booking confirmation, or written agreement will apply.
7. Custom and Personalized Orders
Custom and personalized orders are subject to the Custom Apparel Policy and any order-specific instructions, proofing, approvals, production requirements, and final-sale terms. Customers are responsible for reviewing spelling, wording, sizing, quantities, colors, design placement, artwork, and other specifications before approval.
Once a customer approves a proof or order specification, CDubz DeZigns may rely on that approval to source materials and begin production. Later changes may not be possible and may result in additional charges or a revised timeline.
8. Customer-Submitted Content and Permissions
When a customer submits artwork, photographs, logos, names, wording, trademarks, or other material for use in a custom order, the customer represents that they have the necessary permission or legal right to request that material be reproduced or used for the order.
CDubz DeZigns may decline content that appears unlawful, infringing, deceptive, hateful, threatening, or otherwise inappropriate for the requested service. Acceptance of customer-provided content does not mean CDubz DeZigns has independently verified ownership or licensing rights.
9. Shipping, Returns, Cancellations, and Order Issues
Shipping, local pickup, carrier delays, final-sale terms, damaged or incorrect items, cancellations, order changes, and similar issues are governed by the corresponding CDubz DeZigns website policies and any order-specific terms. Those policies are incorporated into these Terms by reference.
10. Boutique Experiences
Boutique Experience inquiries, reservations, payments, cancellations, rescheduling, travel, venue access, weather planning, event timing, and event-site responsibilities are governed by the Boutique Experiences Booking, Cancellation & Travel Policy and the quote, invoice, booking confirmation, or written agreement for the specific event.
11. CDubz DeZigns Intellectual Property
Unless otherwise stated, the CDubz DeZigns name, branding, website content, original graphics, photographs, product presentation, copy, designs, layouts, downloadable materials, and other original content created for the business are owned by or licensed to CDubz DeZigns and are protected by applicable intellectual-property laws.
Website visitors and customers may view the website and use purchased products for their intended personal or authorized business use, but may not copy, reproduce, distribute, sell, republish, modify, remove branding from, or commercially exploit CDubz DeZigns website content or original creative materials without permission.
12. Prohibited Uses
The website may not be used for fraud, unlawful activity, infringement of intellectual-property or privacy rights, transmission of malicious code, unauthorized access, interference with website security or operation, deceptive transactions, automated scraping that disrupts the website, harassment, or other activity that violates applicable law or the rights of CDubz DeZigns or others.
CDubz DeZigns may restrict access, decline service, cancel a transaction, or take other reasonable action when misuse, fraud, security threats, unlawful conduct, or material violation of these Terms is suspected or confirmed, subject to applicable law.
13. Third-Party Services and Links
The website may rely on or link to third-party services such as Shopify, payment processors, shipping carriers, social-media platforms, analytics tools, or other technology providers. CDubz DeZigns does not control every aspect of those third-party services and is not responsible for their independent websites, policies, availability, or practices.
Use of a third-party service may also be subject to that provider's own terms and privacy policies. Customers should review those terms when appropriate.
14. Website Availability and Disclaimer
CDubz DeZigns works to maintain accurate and functional website information but does not guarantee that the website will always be uninterrupted, error-free, secure, or available at every moment. Temporary maintenance, platform issues, outages, browser or device differences, or circumstances outside reasonable control may affect access.
To the extent permitted by law, website content is provided for general shopping and informational purposes without guarantees beyond any express commitments made in these Terms, the applicable product description, order-specific agreement, or rights that cannot legally be waived.
15. Limitation of Liability
To the extent permitted by applicable law, CDubz DeZigns will not be liable for indirect, incidental, special, consequential, or similar losses arising solely from use of or inability to use the website, third-party services, or delays or events outside CDubz DeZigns' reasonable control.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited, or to waive mandatory consumer rights. Any responsibility for an order or service will be evaluated under the applicable facts, written terms, and law.
16. Responsibility for Misuse or Rights Violations
A customer may be responsible for losses, claims, or reasonable costs caused by the customer's unlawful misuse of the website, fraudulent transaction activity, or submission of content that infringes another person's intellectual-property, privacy, publicity, or other legal rights. This section applies only to the extent permitted by applicable law.
17. Severability and No Waiver
If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permitted. A decision by CDubz DeZigns not to enforce a provision on one occasion does not automatically waive the right to enforce that provision later.
18. Governing Terms and Applicable Law
These Terms, the policies incorporated into them, and any order-specific quote, invoice, approval, booking confirmation, or written agreement together form the terms applicable to the relevant transaction. If there is a direct conflict, the more specific written term for that transaction will control.
Applicable law governs these Terms and transactions with CDubz DeZigns. Nothing in these Terms is intended to remove consumer protections or other rights that apply regardless of contractual choice.
19. Changes to These Terms
CDubz DeZigns may revise these Terms when website features, products, services, technology, policies, or legal requirements change. The updated effective date should be posted with the revised Terms. Material changes will apply prospectively unless applicable law or the nature of the change requires otherwise.
